Hillary Clinton started dodging questions about the 2012 terrorist attack in Benghazi even before the bodies of four dead Americans were returned home.
First, she was running out the clock before voters went to the polls for President Obama’s re-election effort. Then, she was trying to frustrate efforts in Congress to hold her feet the fire. Now, she’s trying to keep a lid on any exploding Benghazi news before Election Day.
But if the parents of two of the Americans who died at the U.S. compound in the Libyan city have their way, Hillary has run out of time herself.
An attorney representing Patricia Smith and Charles Woods, whose sons were among the American dead of Benghazi, is asking a federal judge to issue a default judgment against Clinton in a blockbuster lawsuit they’ve filed against the former secretary of state. The reason for the request — Clinton has failed to respond to the suit before a deadline imposed by federal court rules.
In typical dodgy fashion, Hillary has looked the other way and not even submitted the necessary paperwork — adding gross insult to injury to the Benghazi families for whom she has shown such disregard and disrespect.
In the lawsuit, Smith and Woods accuse Clinton of contributing to their sons’ deaths by being “extremely careless” with classified information in a way that endangered covert operations like the Benghazi outpost. They also charge the former secretary of state with engaging in a “smear campaign to paint Plaintiffs as liars in the public eye in order to discredit Plaintiffs, who have been vocal about Defendant Clinton’s pattern and practice of dishonesty regarding what caused the Benghazi attack, its aftermath, and the death of their sons.”
Patricia Smith is the mother of Sean Smith, a State Department information officer stationed at the Benghazi outpost. Woods is the father of Tyrone Woods, a former Navy SEAL working as a security contractor at the time of the attack.
Both have said repeatedly that Clinton had lied to them about the deaths of their sons, blaming the Sept. 11, 2012, attack on the American outpost in Libya on an obscure internet video that allegedly inflamed Muslims across Africa and the Middle East.
According to the lawsuit:
Immediately after the attack, Defendant Clinton, in an effort to save the re-election chances of President Barack Obama, and in turn, her own chances at the 2016 Presidency, lied to Plaintiffs and the public at large that the Benghazi Attacks were caused by Islamic reaction over an anti-Muslim YouTube video that had been posted on the internet. These lies were perpetrated despite the fact that she knew immediately that this video was actually not the cause of the attack—information that she shared with the Prime Minister of Egypt and her own daughter, Chelsea Clinton, but hid from Plaintiffs and the public at large.
Clinton has since denied telling the parents that she had said anything to them about the video causing their sons’ deaths, essentially accusing them of lying to the American people – something the Clintons know more than a little about. Patricia Smith has been particularly outspoken in her public condemnation of Clinton’s lying to her face.
According to the filing by attorney Larry Klayman, founder of the conservative activist groups Judicial Watch and Freedom Watch, Clinton has failed to respond to the lawsuit, which was served at her campaign headquarters Aug. 9.
The Federal Rules of Civil Procedure specify that Clinton had 21 days — or until Sept. 1 — to either respond to the summons or request an extension, but she did neither.
Given that the summons was delivered to her campaign office, it’s unclear whether she herself was actually served – or properly served. And if anyone knows the ins and outs of dealing with process servers, it’s Hillary Clinton. (She’s probably on a first-name basis with half of the process servers in the Acela Corridor by now.)
But she can’t pretend she didn’t know about it — the lawsuit was so widely covered in the mainstream media that The New York Times reported on it. So she and her supporters are clearly ignoring it, arrogantly assuming — once again — that the laws that apply to the rest of America don’t apply to crime families named Clinton.
But Klayman’s filing on behalf of Smith and Woods is a reminder that the deaths in Benghazi aren’t going to stop haunting Hillary’s campaign.
And her time is running out.
